The Andalucian Government recently passed new legislation in November 2021, (Published in the Andalucia Gazette on November
22/2021) seeking to introduce a number of measures designed to renovate and modernize the touristic accommodation sector.
The new Law aims to provide, the possibility to encourage investment for owners of any such touristic constructions, (La Colina),
with a view to either making improvements to a higher category of accommodation, or of increasing usable surface area to
increase the number of hotel beds available. This work is allowable as long as other investments are also made, i.e installation of
digital connections etc.
The Law states the provision of a period of three years from the date of its publication, for any such investments to be taken on,
subject to planning permission from the local municipality. However, these municipal authorities are instructed under the new
Law, to change their planning norms immediately to cater for the various possibilities which the new Law offers. I.e San Roque
Town Hall would not be able to reject any application for planning permission to increase a usable area of La Colina, should this be
requested as part of a modernising of the property.
